These terms and conditions constitute a binding legal agreement between you (the “User,” “Participant,” or “Customer”) and Breakers Surf Academy. If you do not agree with any part of these terms and conditions, you must immediately discontinue use of our website and refrain from booking or participating in any of our services. Your continued use of the Site or services after any modifications to these terms constitutes acceptance of such changes.
2. Services Offered
Breakers Surf Academy provides a comprehensive range of surf-related services and experiences, including but not limited to:
– Surf camps and individual lessons for all skill levels, from beginner to advanced
– Surf and yoga retreats combining wellness practices with surf instruction
– ISA-certified surf instructor training programs leading to internationally recognized qualifications
– Accommodation arrangements in partnership with local providers
– Optional extras and add-on services such as meals, local tours, equipment rental, transportation, and cultural experiences
All services are offered subject to availability, weather conditions, and confirmation at the time of booking. We reserve the right to modify, substitute, or discontinue any service with reasonable notice. Service descriptions on our website are provided for informational purposes and may be subject to change based on local conditions, seasonal variations, or operational requirements.
3. Bookings & Payments
To secure your reservation with Breakers Surf Academy, a deposit or full payment is required at the time of booking confirmation. The deposit amount varies depending on the service selected and will be clearly communicated during the booking process.
Payment Schedule:
– Full payment is typically required 30 days before the start of your program, unless alternative payment arrangements have been specifically agreed upon in writing
– For bookings made within 30 days of the program start date, full payment is required immediately upon booking confirmation
Payment Methods:
All payments are processed securely through trusted third-party payment providers including Stripe, PayPal, or direct bank transfer to our designated accounts. We do not store your financial information on our servers.
Price Policy:
Prices displayed on our website are subject to change without notice prior to booking confirmation. Once your booking is confirmed and payment is received, the agreed price will remain fixed. All prices are quoted in USD unless otherwise specified and may be subject to applicable taxes or fees.
4. Cancellations & Refunds
Cancellations by You (Participant):
More than 60 days before program start date:
– Full refund of all payments made, minus processing fees (typically 3-5% of total payment)
– Processing fees cover third-party payment processor charges and administrative costs
30-60 days before program start date:
– 50% refund of total amount paid
– The remaining 50% helps cover committed costs for accommodation, equipment, and staff preparation
Less than 30 days before program start date:
– No refund available
– This policy reflects our inability to reallocate reserved resources at short notice
Cancellations by Breakers Surf Academy:
We reserve the right to cancel or reschedule programs due to circumstances beyond our reasonable control, including but not limited to extreme weather conditions, natural disasters, safety concerns, government restrictions, insufficient enrollment numbers, or operational emergencies. In such cases:
– You will be offered a full refund of all payments made
– Alternative program dates may be offered if available
– We will make reasonable efforts to provide as much advance notice as possible
Force Majeure: Neither party shall be liable for delays or failures in performance resulting from acts beyond reasonable control, including natural disasters, government actions, war, terrorism, or pandemic-related restrictions.
5. Travel & Insurance Requirements
All participants are required to maintain valid and comprehensive travel and health insurance coverage throughout their participation in our programs. This insurance must specifically include:
– Coverage for water-based and adventure sports activities, including surfing
– Medical emergency coverage with minimum coverage of $50,000 USD
– Emergency evacuation and repatriation coverage
– Personal liability insurance
– Coverage for trip cancellation and interruption
Limitation of Liability: Breakers Surf Academy accepts no responsibility or liability for expenses, losses, or damages resulting from lost baggage, flight cancellations or delays, travel disruptions, medical emergencies, or injuries not directly caused by our proven negligence. Participants acknowledge that they participate in all activities at their own risk and expense beyond the scope of services directly provided by Breakers Surf Academy.
6. Participant Responsibility & Conduct
By joining our programs, you acknowledge and agree to the following responsibilities:
Safety Compliance:
– Follow all instructor guidance and safety instructions at all times
– Use provided safety equipment as directed
– Respect ocean conditions and local surf etiquette
– Immediately report any safety concerns or incidents
Health Disclosure:
– Provide complete and accurate information about your swimming ability, surf experience, and physical fitness level
– Disclose any relevant medical conditions, medications, allergies, or physical limitations that could affect your participation
– Inform us immediately of any changes to your health status during the program
Behavioral Standards:
– Respect local customs, traditions, and environmental practices
– Treat fellow participants, instructors, and staff with courtesy and respect
– Refrain from behavior that may endanger others or disrupt the program experience
– Comply with local laws and regulations
Risk Acknowledgment:
You acknowledge and voluntarily accept the inherent risks involved in surfing, yoga, and related physical activities, including but not limited to drowning, cuts from reefs or equipment, marine life encounters, and musculoskeletal injuries.
Removal from Program:
We reserve the right to immediately remove any participant whose behavior endangers others, violates local laws, disrupts the program, or fails to comply with safety instructions, without refund or compensation.
7. Comprehensive Liability Waiver
Participation in Breakers Surf Academy services involves inherent physical risks and exposure to natural elements that cannot be completely eliminated. These risks include but are not limited to:
– Ocean-related hazards (waves, currents, marine life, changing conditions)
– Equipment-related injuries
– Weather-related incidents
– Transportation accidents
– Slips, falls, and impact injuries
– Pre-existing medical condition complications
By booking and participating in our services, you:
– Acknowledge full awareness of these risks
– Voluntarily assume all risks associated with participation
– Release Breakers Surf Academy, its owners, employees, contractors, and partners from liability for injuries, accidents, losses, or damages except those resulting from our proven gross negligence or willful misconduct
– Agree to hold harmless and indemnify Breakers Surf Academy against any claims arising from your participation
This waiver applies to all activities, whether specifically mentioned or not, and extends to transportation, accommodation, and ancillary services arranged through our programs.
8. Website Use & User Conduct
